CMA LAW: Press Release: The Capital Market Authority Issues the First Permission for Institutional Marketing to Goldman Sachs International Company

Kuwait, August 06, 2026 – Within the framework of implementing its strategic objectives related to the development of the markets system, and as part of its efforts that aim to provide a regulatory environment for the establishment and development of investment instruments required for meeting the needs of local and foreign investors of various segments, the Capita Markets Authority (CMA) announces granting the first permission for institutional marketing of a collective investment scheme incorporated outside the State of Kuwait to Goldman Sachs International Company, which is licensed by Kuwait Direct Investment Promotion Authority (KDIPA).
This resolution reflects the CMA’s vision to enhance the attractiveness of the Kuwaiti market as an attractive destination for international financial institutions, and to foster an encouraging environment for practicing local financial activities. The CMA emphasizes that granting institutional marketing licenses to global entities such as Goldman Sachs International Company in accordance with the regulatory framework established by the CMA represents a key pillar for driving foreign investment, securing an integrated business environment, and providing the appropriate environment and necessary facilities for both foreign and local investment.
It is worth noting that “Institutional marketing of a collective investment scheme incorporated outside the State of Kuwait” means marketing, offering, arranging, or coordinating subscriptions to one or more investment funds and other collective investment schemes incorporated outside the State of Kuwait to professional clients only, which includes government entities, licensed persons, or investment funds, and other financial institutions subject to the supervision of a regulatory body, and any company with a paid-up capital of no less than one million Kuwaiti Dinars.
On this occasion, the CMA emphasizes that this regulatory approach is based on its belief in the ability of professional clients to make their investment decisions independently, due to their high financial solvency, integrated institutional infrastructure, and technical resources that enable them to conduct prudent self-assessments for investment opportunities.
The CMA mentioned that this category of investors possesses a relatively higher capacity to understand, absorb, and bear investment risks compared to qualified professional clients in most cases. This necessitates drafting flexible legislations that align with their substantial financial solvency and support the attraction of foreign investors.
This resolution exemplifies the fruitful and constructive cooperation between the CMA and KDIPA and aims to facilitate the entry of foreign investors and elevate the efficiency of the local investment environment in line with Kuwait Vision 2035 to build a diversified economy driven by innovation and investment, enhance regional and international competitiveness, and foster an attractive business environment for global institutions.

The Capital Markets Authority was established pursuant to Law No. 7/2010, approved by the Kuwaiti Parliament in February 2010. Pursuant to the Law, the CMA shall regulate and supervise the securities activities, achieve transparency and fairness, observe listed companies’ execution of Corporate Governance regulations, and protect investors from unfair practices which violate the CMA's Law.
Furthermore, the Law's provisions stipulate the supervision of mergers, acquisitions, and disclosure operations. The CMA also aims to provide awareness programs related to securities activities.
