CMA LAW: Circular No. (10) of 2024 to All External Parties Regarding the Controls for Addressing the Capital Markets Authority

Within the framework of CMA's continuous efforts to strengthen communication with all external parties, whether they are persons subject to its supervision or not, in order to optimally implement the provisions of Law No. 7 of 2010 Regarding the Establishment of the Capital Markets Authority and Regulating Securities Activities and its Executive Bylaws, and their amendments in the best way, and to achieve its objectives in terms of regulating securities activity in a fair and transparent manner, developing capital markets, providing the highest levels of protection for those dealing in securities activities, and reducing the expected systemic risks in securities activities.
Accordingly, the CMA draws the attention of all external parties subject to its supervision to comply with the following controls when addressing it to request an opinion and respond to inquiries, such as:
First: Correspondence submitted to the CMA shall be signed by the legal representative of the party or his authorized representative according to its establishment document.
Second: Stating whether the subject of the request is pending before the judiciary or not.
Third: Stating whether the subject of the request is under investigation by any state entity.
