CMA LAW: Awareness Workshop "Investigation Procedures under CMA Law"

Kuwait, 19th May 2015 - The CMA has continued its awareness program for the second quarter of 2015. The 6th workshop took place on Tuesday 19/5/2015 regarding the investigation procedures.
The workshops are usually held in the in Khaled Al-Kharafi Hall at Kuwait Stock Exchange at 12:30 p.m. on Tuesdays.
This workshop has tackled the investigation procedures through different aspects as follows:
Functions of the Investigation Department in respect of the internal and supervisory matters.
CMA competences regarding the investigation procedures
Articles of CMA Law No. 7 of 2010 regarding the Establishment of the Capital Markets Authority and Regulating Securities Activities which regulates the investigation procedures
Investigation assurances
The workshop mainly focused on the investigation itself. It began by defining it and then reviewing in detail CMA competences concerning the investigation. The first step starts by receiving the complaints and then investigating them according to the adopted and approved procedures in the CMA, in addition to the procedures that may lead to reveal the crimes stated in Law No. 7 of 2010. The Articles which regulated such procedures were also reviewed.
The workshop discussed the powers that shall be given to the investigator in order for him/her to conduct his/her duties. It also reviewed the most important statistics of the investigation procedures in the suspected violations and its consequences.

At the end, participants' questions were answered by the representatives of the Investigation Department.

The Capital Markets Authority was established pursuant to Law No. 7/2010, approved by the Kuwaiti Parliament in February 2010, and amended by Law No. 108/2014. Pursuant to the Law, the Authority shall regulate and supervise the securities activities, achieve transparency and fairness, oblige the listed companies to execute the Corporate Governance Principles, and protect the investors from the unfair practices which violate the Authority's Law.
Furthermore, the Law's provisions stipulate the supervision of the merger, acquisition, and disclosure operations. The Authority also aims at providing awareness programmes related to securities activities.
