CMA LAW: Press Release: The Capital Markets Authority Publishes the 25th Issue of its Electronic Awareness Magazine

Kuwait, September 2, 2026 – The Capital Markets Authority’s (CMA) electronic awareness magazine published its 25th issue first of September. The issue included different awareness and legal subjects, as it covers CMA news updates and its recent activities during the months of June to August 2026.

The issue commences with the “Editorial” by Mr. Emad Ahmed Tifouni - Chairman of CMA’s Board of Commissioners and Managing Director, in which he presented CMA’s efforts in the various paths of sustainability: institutional, community, and those related to securities activates, indicating that CMA seeks to lead the positive change in local securities activities sector to a more sustainable future for the coming generations by merging the initiatives  of capital markets development with sustainability standards, while aligning with the “New Kuwait” vision, and consolidating the State’s position as a leading center in sustainable development in particular.

Subjects of this Issue varied in its regular sections. The “Economic Leaders” section discussed the journey of Mr. “Muhammad Naser AlHajeri”, and his contributions in national, pan – Arab and humanitarian areas. The “Legal Section”, on the other hand, discussed the topic of “The Impact of the Peremptory Rule of Confidentiality in Law No. 7 of 2010 on the Objective Scope of the Right of Access", reassuring that the efficiency of the legal system in capital markets is not measured by its absolute openness or closure, but by its ability to achieve flexible balance between transparency and principle of accessibility on one hand, and protecting investor secrets and principle of absolute confidentiality on the other.

As for the “Issue Event” section, it discussed the recent remarkable regulatory momentum related to market regulation, which has been translated into qualitative initiatives across key sectors of the capital market ecosystem in general, and specifically in the areas of listing and trading, such as launching the regulatory framework for Exchange-Traded Funds (ETFs) and reviewing trading commission structure.

In the “Opinion and Vision” section, Mr. Jassim Qazar Al-Jassim, Director of the Court of Cessation Clerks Department in the Ministry of Justice, presented a reading of the Court of Cassation ruling regarding the "Quorum for convening the general assembly of a shareholding company and the effect of the attachment of shares", emphasizing the importance of verifying the quorum at the time of the General Assembly convenes, rather than afterwards, while clarifying the responsibility of the company, through its Board of Directors and Secretary, in this regard.

The “Issue Interview” of this Issue was with Mrs. Dania Kakouli – Senior Analysis at the CMA’s Markets Sector. The interview focused on Exchange-Traded Funds (ETFs) platform, representing a new step toward enhancing the efficiency and development of local capital market, particularly given the advantages it offers to both investors and the market alike.

The “Awareness Section” presented multiple subjects, such as the recurring findings among certain institutions despite controls and effective oversight procedures, which reveals gaps unseen by policies. This section also presented the subject of “Regulating Insider transactions” and its essential role in protecting market against unfair practices and enhancing investor confidence. The final subject of the section addressed investment setbacks, viewing them not as losses, but as investments in experience. This was followed by the information security section dedicated for safe browsing mechanisms amidst rising threats.

The “Issue File” section, dedicated to Financial Technologies, presented in its first part the “Digital Identity and Electronic Verification” as the current pillars of trust in financial services, while the second part presented the transition of supervisory technology from traditional oversight to smart oversight.

In the same context of Financial Technologies, “Prospects and Trends” section presented the developments of this industry as it undergoes its fifth era, discussing the major trends expected to shape its prospects, which can be summarized as follows: artificial intelligence, digital assets, obtain banking licenses, and the growth of fintech companies that support financial institutions.

“Studies” section handled the same subject, presenting the close interlinkage between financial technologies and financial innovation amidst the rapid developments currently witnessed by global financial markets.

On his behalf, Mr. Mohammed Al-hameed - Development and Technical Studies Unit Manager at the CMA – presented in the “To the Core” section, the company's risk tolerance, emphasizing the need to establish an effective framework in this regard.

In the issue’s concluding section “In Conclusion" of the editor-in-chief of the magazine, Mr. Khaled Al-Saqer - Director of the Awareness and Public Relations and Communication Office at the CMA, was titled “Institutionalizing Sustainability at the CMA: Investing in Human and Social Capital”, in which he outlined the CMA’s initiatives aimed at creating the necessary link between capital market development as a pillar of economic growth, and social development as a key instrument for achieving sustainable development, which is urgently needed in today’s world due to its crucial role in ensuring economic and social stability.

Finally, it is worth noting that the Capital Markets Authority’s electronic awareness magazine is a quarterly publication dedicated to financial, investment, and legal awareness issues related to securities activities.

The Capital Markets Authority was established pursuant to Law No. 7/2010, approved by the Kuwaiti Parliament in February 2010. Pursuant to the Law, the CMA shall regulate and supervise the securities activities, achieve transparency and fairness, observe listed companies’ execution of Corporate Governance regulations, and protect investors from unfair practices which violate the CMA's Law.

Furthermore, the Law's provisions stipulate the supervision of mergers, acquisitions, and disclosure operations. The CMA also aims to provide awareness programs related to securities activities.
