Title: Resolution No. (82) of 2025 Regarding the License Application Submitted by Kuwait International Trustee Company to Practice Securities Activities
Having Perused:
- Law No. 7 of 2010 regarding the Establishment of the Capital Markets Authority and Regulating Securities Activities and its Executive Bylaws and amendments thereto; and
- Based on Resolution No. (31) of 2016 issued on 13/04/2016 regarding Granting Initial Approval for the Incorporation of a Kuwaiti Closed Shareholding Company to Practice Securities Activities Pursuant to Law No. 7 of 2010 Regarding the Establishment of the Capital Markets Authority and Regulating Securities Activities and its Amendments; and
- Based on Item (22) of Appendix No. (3) of the Transitional Provisions of Resolution No. (72) of 2015 Issued on 9/11/2025 Regarding the Issuance of the Executive Bylaws of Law No. 7 of 2010 on the Establishment of the Capital Markets Authority and Regulating Securities Activities and its Amendments; and
- Based on the license application submitted by Kuwait International Trustee Company to; and
- Based on Resolution No. (04) of 2025 regarding the amendment of the approval authorizations for the Supervision Sector's procedures, issued on 12/01/2025.
The Following Was Resolved
Article (1)
The CMA hereby grants an approval to Kuwait International Trustee Company for licensing the following activities:
1. Custodian.
2.Investment Controller.
Article (2)
The license term for the mentioned Company shall be three years, starting from the issuance date of the CMA’s license, and after paying the prescribed fees.
The Company shall pay the prescribed fee upon license renewal according to the provisions of CMA’s Law No. 7 of 2010 and its Executive Bylaws their amendments, resolutions, and directions.
Article (3)
The Kuwait Clearing Company shall complete the transfer of all custodian and investment controller activities to Kuwait International Trustee Company, along with all related procedures, within a maximum of six months from the date of issuance of this Resolution.
Article (4)
The concerned bodies shall execute this Resolution, each within its jurisdiction. This Resolution shall come into force from the date of issuance and it shall be published in the Official Gazette.
